1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of TrustBoard, a software platform operated by TrustBoard ("Company," "we," "us," or "our"). By creating an account, joining a community, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms apply to all users, including community administrators, board members, and general members.
2. Description of Service
TrustBoard is a software-as-a-service platform that provides private community knowledge-base tools. The Service allows community administrators to organize documents, publish notices, maintain vendor directories, manage FAQs, and use AI-assisted search features within a private community portal.
The Service is a software tool only. TrustBoard is not a law firm, property management company, financial advisor, HOA compliance authority, tax advisor, or professional services firm. Nothing in the Service — including documents, AI answers, notices, vendor listings, or any other content — constitutes legal, financial, tax, HOA compliance, property management, or professional advice of any kind.
3. Account Registration and Community Administration
To use the Service, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Community administrators are solely responsible for:
- Managing member access, roles, and permissions
- The accuracy, completeness, and legality of all uploaded documents and content
- Ensuring that uploaded content does not violate applicable laws or third-party rights
- Ensuring their community's use of the Service complies with all applicable laws and regulations
- Informing their members about how community data is stored and used
TrustBoard is not responsible for any actions taken, or omitted, by community administrators or members.
4. Acceptable Use
You agree not to use the Service to:
- Upload content that is unlawful, defamatory, harassing, fraudulent, or infringing on third-party intellectual property rights
- Distribute malware, viruses, or malicious code
- Attempt to gain unauthorized access to any part of the Service or another user's account
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to scrape, crawl, or extract data from the Service without authorization
- Upload or transmit sensitive personal data (such as Social Security numbers, financial account numbers, or medical records) unless strictly necessary and with appropriate consent
- Engage in any activity that violates applicable local, state, national, or international law
We reserve the right to suspend or terminate accounts that violate these provisions, without notice, at our sole discretion.
5. User Content and Uploaded Documents
You retain ownership of all content you upload to the Service ("User Content"). By uploading content, you grant TrustBoard a limited, non-exclusive, royalty-free license to store, display, and process that content solely as necessary to provide the Service.
You are solely responsible for all User Content. We do not verify, validate, review, or endorse any documents, notices, vendor information, FAQs, or other content uploaded by users. We are not responsible for:
- Incorrect, outdated, incomplete, or inaccurate documents or information uploaded by users
- Decisions made based on uploaded content, AI search results, AI-generated summaries, vendor listings, notices, or any other community content
- Any harm, loss, or liability arising from reliance on content provided through the Service
Community members should always verify important information against official documents and consult qualified professionals when making significant decisions.
6. AI Features — Important Limitations
The Service includes AI-powered features such as document search, question extraction, and suggested answers. These features are informational only and are subject to significant limitations:
- AI answers may be incomplete, incorrect, outdated, or based on improperly uploaded documents
- AI answers are generated based on content you have uploaded and do not constitute professional advice
- AI-generated question-and-answer pairs must be reviewed and approved by a community administrator before being displayed to members
- Users must always verify AI-generated answers with official community documents and, where appropriate, with qualified legal, financial, or professional advisors
- TrustBoard is not responsible for any decisions made in reliance on AI-generated content
We reserve the right to modify, disable, or discontinue AI features at any time without notice.
7. Vendor Directory
The vendor directory feature allows community administrators to list service providers for reference purposes. Vendors listed within a community portal are listed by community administrators, not by TrustBoard.
TrustBoard does not endorse, verify, license, insure, or warrant any vendor listed in any community's vendor directory unless explicitly and separately stated in writing by TrustBoard. Communities are solely responsible for vetting, selecting, and contracting with any service providers. TrustBoard is not liable for the quality, safety, or conduct of any vendor.
8. Intellectual Property
The TrustBoard platform, including its design, software, branding, and documentation, is the intellectual property of TrustBoard and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without prior written consent.
You retain all rights to your User Content. Nothing in these Terms transfers ownership of your content to us.
9. Subscription and Payment
Access to certain features of the Service may require a paid subscription. Subscription terms, pricing, and billing cycles will be presented at the time of purchase. All fees are non-refundable unless otherwise stated or required by applicable law. We reserve the right to modify pricing with reasonable prior notice.
Payment processing is handled by third-party providers. TrustBoard does not store raw payment card data.

10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUSTBOARD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Damages arising from your use of or inability to use the Service
- Decisions made based on AI search results, AI summaries, vendor listings, notices, documents, or any community content
- Unauthorized access to or alteration of your data
- Loss of data, revenue, profits, goodwill, or business opportunity
- Any claim related to HOA compliance, property management, legal disputes, or financial matters
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless TrustBoard and its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.
13. Termination
We reserve the right to suspend or terminate your account or access to the Service at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including Sections 5, 8, 10, 11, 12, and 15.

14. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TrustBoard is registered, without regard to its conflict-of-law provisions.

16. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
